Patient Terms of Use

Effective date: 21 March 2024

PX6 Medical Systems, Inc. (DBA PX6 Medical Tourism) provides online healthcare services to its registered patients through the web patient portal and mobile application of PX6 Medical Systems, Inc. Usage of these applications to access these services are subject to the acceptance of these Terms of Use.

If you do not agree to these Terms of Use and/or are not eligible or authorized to agree to these Terms of use, then you are not authorized to use the applications and services supported by PX6 Medical Systems, Inc. By using this application, you are accepting these Terms of Use and are legally bound by all terms in this Terms of Use agreement.

1. User Accounts

As a registered patient of PX6 Medical Systems, Inc. you can access your patient user account and applicable services, using the user account details provided by PX6 Medical Systems, Inc. Patients who choose to self-register through the patient portal or patient mobile application will need to wait until their registration is confirmed by PX6 Medical Systems, Inc., before their account is active. By registering, you agree that:

  • You are not impersonating any other person and are using your actual identity.
  • Your registration is subject to verification and confirmation by PX6 Medical Systems, Inc. and your patient user account will be activated only after confirmation.
  • The personal information provided during the registration process is true, accurate, current and complete. You are required to periodically review and update your registration data to ensure that it is always current and correct.
  • Your username and password are unique to you, and you agree not to disclose or share your username and password to or with any third party. You are responsible for keeping your password confidential and for notifying us immediately if your password has been hacked or stolen.
  • You also agree that you will be solely responsible for any activities conducted on or through the patient portal and/or mobile application with your account regardless of whether or not you are the individual who undertakes such activities. This includes any unauthorized access and/or use of your account or your computer. You hereby release and hold harmless PX6 Medical Systems, Inc. from any and all claims and causes of action arising out of or resulting from a third party's unauthorized use of your account.
  • Family user accounts added under your user account should strictly be added only for minors and dependents in your family who cannot operate their own independent user account and who have consented (if able) to you doing so on their behalf. Family members who can have their own phone number and/or email address should set up and operate their own independent patient account. You will receive all notifications related your family account members and will be able to access their accounts. Only a maximum of 6 family user accounts can be included under your user account. By setting up a family user account under your account for a dependent adult family member, you agree that you have done so with necessary consent of the family member.
  • PX6 Medical Systems, Inc. reserves the right to deny or revoke access to any user account at its sole discretion.
  • This application is only a tool to allow patients of PX6 Medical Systems, Inc. to collaborate in their own healthcare, use scheduling and communication services and to access their personal health record maintained by PX6 Medical Systems, Inc.
  • All engagement between your healthcare provider and you through this application are governed by these Patient Terms.
  • As a user of services through the patient portal and/or mobile application of PX6 Medical Systems, Inc. you agree to receive essential service related notifications in the form of SMS, email, mobile push and WhatsApp notifications. Notification settings to turn off non-essential email and SMS notifications are available. Settings to turn off mobile push and WhatsApp notifications are available.
  • You shall not use any service or information in this application for any purposes other than managing your personal health information or that of your immediate family members (with due authorization) and/or to engage with healthcare providers of PX6 Medical Systems, Inc.
  • You are expected to avail of immediate professional medical attention in medical emergencies or critical care situations and not attempt to use the application to access your healthcare provider. The services enabled by the application is only meant to supplement your existing healthcare services and to enable you to collaborate better with your own healthcare providers, as decided by them.
  • As a user of services through the patient portal and/or mobile application of PX6 Medical Systems, Inc. you agree that general media files required in the applications may be served to your devices used to access the applications.
  • Being an online application, there might be unforeseeable network and infrastructure issues in which case the application will not be available until the issue is rectified. Under such circumstances please directly contact PX6 Medical Systems, Inc. in person for any services you may need. PX6 Medical Systems, Inc. is not liable for any periods of non-availability of this application.
  • As a user you may not use automated tools on our applications without our consent, nor cause any degradation of our application services. You may not compromise the privacy and security of any user data, nor cause its modification, misuse or destruction in any way.
  • As a user, you will not use malware or engage in phishing activities to compromise the security of our applications and services.
  • Usage of this application does not make the technology vendor supporting this application, liable for any of the healthcare and/or other services you use through the application, nor does it result in any implied obligation between you and the vendor.
  • PX6 Medical Systems, Inc. will make all possible efforts to provide you the best healthcare services. However, PX6 Medical Systems, Inc. shall not incur any liability and shall declare any service guarantee void in the event the user is in breach of any of the Terms and Conditions of this Agreement
  • Both parties are at liberty to terminate this agreement. Terminating the agreement will cancel only your user accounts in the web and mobile applications of PX6 Medical Systems, Inc. It does not terminate nor impact any other consultations or patient-provider relationship that you have with PX6 Medical Systems, Inc.
2. Data
  • As defined in the Privacy Policy, the application stores data, including Personal Information and PHI data, communications, usage data including but not limited to location, device type, operating system, browser, date-time and context usage, in HIPAA and GDPR compliant cloud infrastructure on Amazon Web services. All data storage and transmissions are encrypted.
  • The accuracy, integrity and completeness of the personal health information you enter, directly sync from health sensor devices and/or sync from your other health or fitness accounts into your health record, is your responsibility, and PX6 Medical Systems, Inc. assumes no liability for it.
  • Any files that you upload into your personal health record in the app, including your profile picture, medical reports and any other file attachments are all securely uploaded and stored in your personal health record in our secure clouds storage.
  • Data in your personal health records will be accessible to and modifiable by authorised healthcare providers of PX6 Medical Systems, Inc., for the purpose of providing you with healthcare services.
  • Non- personalised system analysis of non-identifiable patient data may be done to enable better healthcare outcomes for the patients of PX6 Medical Systems, Inc. However the identity of individual users will remain completely anonymous in such analysis.
  • All user data is covered by the Privacy Policy of PX6 Medical Systems, Inc.
3. Remote Monitoring Services

Our Remote Monitoring packages are only for communicating specific health parameters to the healthcare providers in PX6 Medical Systems, Inc. patient portal and mobile applications and will not substitute actual clinical visits. You are required to visit the healthcare provider as and when specified by your doctor and whenever you need healthcare.

  • If the monitoring feedback provided by the healthcare provider is substantially different from your current treatment and prescribed medication, it is your duty to confirm the same before implementing the advice.
  • The health information, vital sign readings, dates, timings and notes logged in by you or on your behalf should be accurate.
  • As a patient of PX6 Medical Systems, Inc., you are required to inform your healthcare provider of all current and previous illnesses, health conditions, surgeries, consultations and medications with any other healthcare providers. While our healthcare team may help to update your PHR based on mutual agreement, it is your responsibility to update all aspects of the PHR completely and correctly.
  • For efficient monitoring and proper healthcare services, the patient is required to enter all vital health data through the system as per the schedule and level of detail advised by the doctor.
  • For self-monitored readings, it is the patient's responsibility to use devices of proper quality and to ensure that they are re-calibrated when required.
  • The healthcare team of the healthcare provider will consist of qualified healthcare professionals. The monitoring and feedback will be handled by any qualified member of the healthcare monitoring team.
  • The healthcare provider will monitor your vitals at the intervals specified in your package.
  • Not following the instructions of the healthcare team will be considered as non-compliance of the agreement and the agreement will be terminated.
  • The healthcare team will provide instructions based on the vitals entered by you. You are advised to enter the vitals accurately.
  • PX6 Medical Systems, Inc. will not assume any legal responsibility for the patient's medical condition and this online consultation only intends to aid in understanding the condition better based on the information given and is not meant to replace an in-person consultation
  • The online system is expected to enhance, not replace clinic visits. It is your responsibility to schedule follow-up appointments as indicated by your doctor.
  • The patient is free to discontinue using a Remote Monitoring plan at any time, with the knowledge of your consulting healthcare provider.
  • The healthcare provider does not attend to Emergencies through this application. Under these circumstances, the patient has to contact the nearest hospital immediately.
  • PX6 Medical Systems, Inc. may provide one or more Remote Monitoring plans. When signing up for or after being assigned to any such Remote Monitoring package, it is the duty of the patient to understand the instructions and terms of that package and to fulfil them.
  • The patient data will be kept confidential by PX6 Medical Systems, Inc. and will not be disclosed to anyone under normal circumstances except as requested by law or in an emergency situation when requested by another healthcare provider.
4. Video Consultations
  • Video Consultation Appointment Timing:  While the patient may specify the preferred appointment timing for a Video Consultation, PX6 Medical Systems, Inc. reserves the right to schedule the appointment for an alternative timing. If this timing is not convenient, the user can request that it be rescheduled. Due to unpredictable medical emergencies, it may be that the healthcare provider is sometimes unable to attend to the video consultation exactly at the appointed time. In such cases the session might be rescheduled to a later time in consultation with the patient.
  • Video Consultation Duration:  By default the average duration of a Video Consultation will be the duration decided by the healthcare provider. PX6 Medical Systems, Inc. reserves the right to decide when the consultation ends. This could be earlier than the maximum possible duration. If the healthcare provider has to be conclude the video consultation mid-way due to a medical emergency, then a new session at an alternative timing will be scheduled.
  • Video Session Quality:  The quality of the video session depends on the quality of the Internet connection, web cam and audio facilities of both the patient and healthcare provider. It is the responsibility of the patient to ensure that the performance and quality of the equipment and connection used, are optimal for doing video calls online. Video Consultations that fail on account of poor equipment and connectivity will not be rescheduled for free. Nor will there be any refund of payment.
  • Video Session Privacy, Security & Etiquette:  It is required that the patient prepares ahead of time to participate in the Video Consultation, in a quiet and private place, where only the patient is present in the room where the video session is being held. For elderly or disabled patients who require help to participate in the video, a caregiver may be present. There must be no audio/video recording of the video session by the patient. It is necessary that the patient (and any caregiver) act with proper decorum in speech and action during the video consultation. Failure to comply with these requirements can result in termination of the video session with no refund or rescheduling of the consultation.
  • Nature of Consultation:  Video Consultations must not be scheduled for patients with critical medical conditions and/or for emergencies. Such consultations are suitable only for basic follow-ups between the patient and healthcare provider and/or preliminary consultation before meeting the healthcare provider in person.
5. Text or Question Based Consultations
  • Every attempt will be made to provide responses to your questions within the stipulated response time. However do not under any circumstances, delay seeking direct medical attention from your healthcare provider or nearest hospital.
  • Asking medical questions to a healthcare provider, whom you have not been consulting directly, does not necessarily result in establishing a doctor-patient relationship. Any response from the healthcare provider only constitutes helpful information which must be verified with your own doctor.
  • Do not change any medication, treatment regimen or other healthcare measures without confirmation from your own healthcare provider. Any advice or information in responses to your questions/text consultations to healthcare providers of PX6 Medical Systems, Inc., do not qualify as a medical prescription, diagnosis or treatment plan.
  • In the case of any emergency, always contact your own healthcare provider and go to the nearest hospital or healthcare provider.
  • PX6 Medical Systems, Inc. is not liable for any healthcare issues related to the questions raised. Information provided at the time of asking a question must be accurate and complete. This is only to ensure that the response provided is helpful to the patient and does not involve a liability on part of PX6 Medical Systems, Inc.
  • Response time for a question is indicative of only the initial response to the question and does not include the time for responding to follow-up notes. Each follow-up should be expected to require the same response time as the initial question.
  • Payments for this service are covered by the payment terms for services through the patient portal and mobile application.
6. Payments
  • All consultation fees for services through the mobile and web application interfaces of PX6 Medical Systems, Inc. have to be paid as per the terms of the service that you use. Offline payment collection for some of these services is supported too. Please contact PX6 Medical Systems, Inc. about this during your next in-person visit.
  • In course of time, PX6 Medical Systems, Inc. may introduce other services in the system, the charges for which will be communicated to you as and when such services are introduced.
  • The healthcare provider reserves the right to revise the consultation and service charges at any time, at the sole discretion of the healthcare provider. The charge applicable at any given time, will be the charge displayed at the time of using the service.
  • Payments made for any remote monitoring plans will not be refunded should you decide to discontinue.
7. Privacy Policy

Data in this application of PX6 Medical Systems, Inc. can be created by your healthcare providers at PX6 Medical Systems, Inc. and by yourself (the patient) after logging into the application with your authorized user account. Information that is collected as you use our web patient portal and mobile application includes the following:

  • Personal information:  Personal information includes name, email address and/or phone number that you provide at signup. It also includes your profile picture (should you choose to add it to your user account), address and other personally identifiable information that you may choose to add to your user account profile. No payment method information is stored by this application.
  • Personal Health Information:  Personal health information about patients users, that patient users themselves or authorized employees of PX6 Medical Systems, Inc. enter into the Personal Health Record of a patient, including age, gender, known health conditions, medications, allergies, vaccinations, history of surgeries or procedures, goals, health journal entries and data that you enter into your health trackers either manually or by syncing with your health monitoring devices and/or your other health or fitness accounts. Syncing of data from your health or fitness accounts from external third party systems including but not limited to Google Fit and Apple Health app, requires you to authorize access to sync data into your health record. It also includes medical reports and files that you choose to upload into your health profile.
  • Operations Data:  In order to enhance your usage experience and to ensure secure audit mechanisms, the application uses cookies, server logs and other similar mechanisms to enable certain functionality, improve services and monitor service usage. The log data includes context usage, location, device type, operating system, browser, date and time.
  • Cookies Usage Policy: Cookies are used to save user preferences, preserve session settings, help auto-authentication of frequently used services if required by your settings and to enable other similar functional requirements. You may use browser settings to disable cookies when using our web services, however it may result in some of the features and services of this application not functioning properly. The only third-party cookies used by the application are AWS (Amazon Web Services) load balancer cookies required for functioning of this cloud based application. These cookies have a one week expiry. The first-party cookies used by this application are for security and authentication purposes only. One of these cookies has a session lifespan and the other has a one year lifespan.
  • Data Storage Location: All data is stored only on HIPAA and GDPR compliant cloud infrastructure on Amazon Web services. All data transmission and storage are AES encrypted. No data is stored on your mobile devices. The cloud infrastructure is protected by a secure firewall.
  • Access: Data in your personal health records will be accessible to and modifiable by authorised healthcare providers of PX6 Medical Systems, solely for the purpose of providing you with healthcare services.
8. Use of Information

The personal and health information added through this application, through use of its services by patients and healthcare providers of PX6 Medical Systems, Inc. will not be shared, disclosed or displayed to anyone other than authorized employees of PX6 Medical Systems, Inc. They will be able to update personal health information of their own patients by updated the patient health profile, uploading medical reports, adding review notes, health goals, monitoring feedback relevant as part of the consultation services used by the patients.

PX6 Medical Systems, Inc. is fully authorized to terminate patient user accounts at any time and such patients will no longer have further access to their personal health information stored in the application storage in event of that happening. Whether or not to share that information with the patient user before termination of the patient user account is the prerogative of PX6 Medical Systems, Inc.

You have the right to request deletion of your user account with PX6 Medical Systems, Inc. Your account and all data in it will then be completely deleted. We reserve the right to maintain billing data only for our financial records.In the event of any breach of your personal health data, you will be notified.

Contact Information: The services platform will send you communications (email and other notifications), as per your notification settings, as part of essential functioning of services that you may avail, such as appointment booking information, alerts related to reviews and consultations by your healthcare providers. At time of registration you will be required to verify your mail address and/or phone number.Your contact information may also be used for customer support services, should you choose to avail of them. In addition, we may use your contact information to provide you with information about our services. If you decide at any time that you no longer wish to receive such information or communications from us, please change applicable notification settings in your account. Your contact information is not shared with any third-party.

Anonymized data: PX6 Medical Systems, Inc. may analyze anonymized and aggregated collected through the services, for purposes of evaluating healthcare outcomes, healthcare requirement patterns and to measure the effectiveness of services and content. Such anonymized and aggregated information is not considered as personal information. You are responsible for maintaining the confidentiality of your password and account information. You are responsible for all activities that occur in your account and you agree to notify PX6 Medical Systems, Inc. immediately of any unauthorized use of your account. PX6 Medical Systems, Inc. is in no way responsible for any loss that you may incur as a result of any unauthorized use of your user account and password. The technology vendor supporting this platform is not responsible for the privacy policy compliance of any users who have access to data in it. That is the sole responsibility of PX6 Medical Systems, Inc.

9. Disclosure of Information

We may disclose any information to government or law enforcement officials if we believe doing so is required to comply with law enforcement and legal process; to prevent or stop any illegal, unethical, or legally actionable activity; to protect your, our or others rights and safety.

We may disclose your personal information on your own request accompanied by your permission.

PX6 Medical Systems, Inc. does however reserve the right to deactivate or delete accounts of any user found to be in violation of our Terms of Use.

10. Transmission and Storage Security

All data is stored only in the servers of our technology vendor on the highly secure Amazon Web Service platform (which is compliant with HIPAA regulations). Necessary measures in providing secure transmission of personal health information before it is transferred across the Internet from your personal computer or devices are ensured. However, you should be aware of possible risk involved in transmitting information over the Internet as no data transmission can be guaranteed to be 100% secure and of risk that others could find a way to thwart our security systems. As a result, while we strive to protect your personal information, we cannot ensure or warrant the security and privacy of personal information you transmit to us, and you do so at your own risk.

11. Restriction on the Basis of Age

All users of the patient portal and mobile app of PX6 Medical Systems, Inc. are expected to be above 18 years of age. Parents, caregivers/guardians and healthcare providers are allowed to provide and store personal information about others, including minors and children. Any user providing, storing or submitting information on behalf of a child/person under guardianship assumes full responsibility over the submission, use, and transmission of such information.

12. Changes to this Policy

Please note that this Privacy Policy may change from time to time as we continue to offer evolve our services. In the event of any changes in our Privacy Policy, the updated version will be posted here and take effect from the moment of posting.

The above mentioned terms are applicable as long as you are a registered patient of PX6 Medical Systems, Inc. using PX6 Medical Systems, Inc.'s web patient portal and mobile application.

13. Telehealth Policy and Procedure

Our policy at PX6 Medical Systems, Inc. is to provide telehealth as an option for healthcare service delivery to enhance access in ways that are convenient, safe, and equitable for our patients. However, every healthcare provider and physician can only offer clinical advise within the territories and jurisdiction they are licensed to practice. PX6 Medical Systems, Inc. does not intend to offer clinical services across international borders or jurisdictions unless the physician or medical provider also holds permit and license to practice medicine with in the respective territories. PX6 Medical Systems, Inc.'s services are solely for the purpose of document review, case analysis, coordination and creation of collaborative environment across international lines. PX6 Medical Systems, Inc. is a Cyber Human Physical System (CPHS) that intends to primarily engage patients with in their own health, coordinate care plan and journey across international borders and locally.

Terminology

Cyber Human Physical System (CPHS). We are a network of humans, digital sensors over a cyberspace where all players and connect virtually and collaborate in real-time. Likewise, they can disconnect from the system as they wish.

Telehealth. For purposes of this policy and procedure, by telehealth we mean the discrete set of codes and services that can either be provided in-person or by using an interactive audio and video telecommunications system that permits real-time communication between the clinician at the distant site and the beneficiary at the originating site.

Distant site. We are the distant site when we deliver telehealth services to patients at a different location, including their home.

Originating site. This is the site where the patient is and may be when:

  • We deliver telehealth services to a patient at a different location, including their home – either of which would be the originating site, or
  • A clinician/specialist at a different location delivers telehealth services to a patient at our clinic, making our clinic the originating site.
Procedures
Scheduling as Originating Site

When one of our patients is scheduled to receive telehealth services at our location from a clinician/specialist, we will provide a private space with camera, microphone and headset for the patient to engage in the telehealth visit. The patient will be advised to arrive 30 minutes prior to the appointment to set up and test the equipment. The patient will be offered a knowledgeable staff member to accompany the visit to ensure a smooth telehealth experience. Prior to the visit, we will ensure that:

  • The clinician/specialist has been provided with the medical records needed for the visit while adhering to the HIPAA and GDRP Privacy rule governing “minimum necessary†when providing records/information.
  • Both our staff and the clinician/specialist are clear on their roles and responsibilities, especially around consent, documentation and payment.
  • A referral order has been entered so we can close the loop and ensure that our ordering clinician has signed the referral notes/results.
Scheduling as Distant Site

When a patient schedules an appointment, they will be offered an in-person or telehealth visit. If the patient chooses telehealth, reception staff will administer the questionnaire to establish whether the reason for the visit and/or chief complaint is appropriate and will deliver the standard script indicating that the telehealth appointment is made based on information provided in the questionnaire and that if conditions change the patient may need to be seen in person or seek urgent/emergent care. Reception staff will also provide additional scripting to ensure patients are clear on the expectations (i.e., must have a quiet place to take the telehealth visit, no multitasking) and the cost requirements as patients are often surprised that the cost/reimbursement for a telehealth visit is the same as an in-person visit. If patient is a minor, follow guidance in our P&P governing when minors seek health care services. Reception staff will ask ““Do you have a smartphone, tablet, or desktop computer with camera and internet?†If patients have one of the three, they are considered “video-capableâ€. Reception staff will note video capability [insert how this will be documented, ideally as structured data – consider as a social determinant of health.

Patient will be sent appointment confirmation by via PX6 Medical system's patient portal, email or text, depending on patient preference, with date/time of appointment with link for telehealth visit and instructions for connecting and an offer for a “test†telehealth visit.

Before Visit

  • The telehealth visit, the patient will receive an appointment reminder per their preferences portal message.
  • The medical assistant (MA)/nurse on the patient's care team will identify all current preventive and chronic gaps in care to discuss with patient prior to meeting with the clinician. The MA/nurse will also identify any outstanding orders or referrals to discuss with the patient and/or clinician to determine the status – pending, need to cancel, waiting for referral notes/results, etc.
Day of Visit

All clinic participants on the call will clearly introduce themselves to the patient and wear or otherwise display their first and last names and credentials.

MA/nurse will:
  • Confirm the patient's identity – picture on file, name, date of birth, etc.
  • Conduct intake, including the portions usually performed by reception staff for in-person visits
  • Advise the patient how to make their payments
  • Discuss back up plan for if the audio or video fails or the technology otherwise is not working for the patient or the care team, including a number to call the patient or for the patient to call the clinic
  • Confirm and document the patient's physical location in case emergency or other services need to be called to assist the patient in the event of serious signs or symptoms.
  • Act as scribe for clinician [if this is something clinic supports]
  • Perform check-out for the patient at the conclusion of the visit as per our procedure for in-person visits, including asking the patient if they have any additional questions about their treatment plan and scheduling any follow-up or other visits.
Clinician/care team will:
  • Document as per requirements for the given type of visit (e.g., evaluation and management/office visit)
  • Enter the appropriate billing code with modifiers, etc., depending on insurer (this may be the responsibility of billers/coders) After Visit
MA/nurse will:
  • Provide visit notes/summary to patient per patient's preference (mail, email, portal, etc.)
  • Communicate with patient's preferred pharmacy for any prescriptions not transmitted electronically
  • Follow up on all orders/referrals, etc.
  • Ensure patient is clear on co-payment/deductible amounts and how to pay
  • Send telehealth follow-up survey to patient per their preferences
  • Administer the follow-up survey to clinic staff that participated during the telehealth visit, during our designated survey periods (e.g., first week of each calendar quarter for all telehealth visits)
HIPAA Privacy
  • Patients will be advised to use headset/ear buds and must identify for the clinician and care team any other individuals that are present.
  • Clinical team must be in a private space (e.g., exam room or office) or wear headset/ear buds to ensure conversations are private.
General Terms and Conditions for the use of the PX6 Medical Systems, Inc. User portal and website

Greetings, and thank you for visiting the user portal and website of PX6 Medical Systems, Inc. ("www.PX6MedicalTourism.DE & www.PX6PX6 Medical Systems, Inc."). We are pleased to offer our services to you, the User ("User"), and by accessing or using our services, you are bound to the terms and conditions set forth below (the "Terms"). Please take a moment to review these carefully. Additional terms may apply to some of our services. These other terms will be included with the relevant services and become part of your agreement with us if you use them. Our services are of great help to you.

1. PX6 Medical Systems, Inc.'s Scope of Services

PX6 Medical Systems, Inc. is a friendly service platform that provides a marketplace for medical Service Providers, such as hospitals and clinics. We offer additional services to the public, including case management, transfers, medical record translation, on-site medical interpreter, remote second opinion, organization of visas, and accommodation of companions, which may come at an individual cost. We do not directly refer patients to specific Service Providers but instead help users select Service Providers within our network by offering them information based on the User's needs, such as time frame of availability, geographic area, medical conditions, etc. This way, the User can choose from a list of Service Providers (including the name, address, specialization, etc.) and book an appointment with the one they prefer. We strive to ensure the notification is accurate, complete, and correct, but we cannot guarantee this. We also cannot be held responsible for any errors, inaccuracies, misleading or untrue information provided by the Service Providers. The user portal and website should not be seen as a recommendation or endorsement of any Service Provider. We want to ensure that the public can access the best information possible.

PX6 Medical Systems, Inc. is a channel that helps to facilitate communication between the public and medical Service Providers. It offers different inquiry forms and hands-on support for users to learn more about Service Providers' services and select the team they feel comfortable with the most. Meanwhile, at PX6, we continue collaborating with them throughout their journey. However, PX6 Medical Systems, Inc. is not involved in any contractual relationship between the User and the Service Provider, nor does it influence the conclusion or content of the contract. PX6 Medical Systems, Inc. does not assume any rights, obligations, or liabilities concerning the User in any agreement between the Service Provider and the User.

PX6 Medical Systems, Inc. does not offer medical services itself. The information available on its user portal and website, including that provided by Service Providers and other third parties, should not be used as a substitute for medical consultation or examination or to make decisions about starting or stopping medical treatment. We want to remind the public that this information should not be used to replace professional medical advice.

2. Termination of Agreement or Service

The User must sign up to the PX6's patient portal, provide their full name, phone number, and email address and agree to the Terms and Privacy Policy to use PX6 Medical Systems, Inc.'s Services. Signing up for the patient portal is free of charge. However, additional support or services may be available for an extra fee. The exact cost of these services will be displayed within the PX6's patient portal in the appropriate sections. The User can review and make any necessary changes before confirming the order; you are making a binding offer to PX6 Medical Systems, Inc. for the requested service by placing an order. Users will receive an email and/or app notification confirming the receipt of their order, but this does not mean that your offer has been accepted.

The User may request their personal, specific personal, and medical data removed from PX6 Medical Systems, Inc.'s databases at any time by emailing their respective account representative within the PX6 user portal. In line with our Privacy Policies, PX6 Medical Systems, Inc. will delete or block the User's personal data and specific personal data as soon as the request is made. However, to trace and document the history of inquiries of the User or Service Providers in the event of any legal disputes related to Service Providers contacted by the User via PX6 Medical Systems, Inc.'s platform, PX6 Medical Systems, Inc. will retain the User's first and last name and email address. After the User's request, this data will not be used for any other purpose, including promotional purposes. Consumers have the right to withdraw from the contract in accordance with Section 15.

3. Additional Services

PX6 Medical Systems, Inc. offers a range of Additional Services through a 3rd party to help make your medical trip easier. Prices for these services will be provided via our portal before your final selection. We reserve the right to update the prices for these services at any time. These changes will be reflected on the 3rd party profile or presented to you during the consultation process.

The Additional Services we offer include, but are not limited to, a Personal Assistance package. This Service provides complete case management with a dedicated Care Team member who will help you from inquiry to treatment to recovery. We also offer a 24-hour response to your inquiry, the possibility to compare prices through multiple personalized treatment plans, priority appointment scheduling, and secure Payment due to PX6 Medical Systems, Inc. as a guarantor for any deposits paid.

PX6 coordinates a car and chauffeur service to transfer you between the airport, hotel, and hospital. The price is per trip, and discounted package rates are available for more complex transportation needs. We also offer a visa service coordination with 3rd party, which covers the provision of an invitation letter for medical treatment visas. Any extra charges must be paid directly to the embassy. Additionally, we provide an on-site medical interpreter, paid hourly, to accompany you at the hospital and facilitate communication between medical staff and the User. This Service can be booked for at least two hours, and we offer discounted rates for medical interpretation exceeding 8 hours.

This Service provides friendly logistical assistance to the public, helping them to find and book travel and accommodation for their treatment destination. A PX6 Medical Systems, Inc. representative will present the User with all-inclusive packages, which include flights and housing, and discuss the contents and price of the package with them. All conditions will be provided with booking the package, and the traveling User pays the costs of the actual accommodation and/or flights.

PX6 Medical Systems, Inc. offers a friendly and convenient way to get a second opinion on your medical diagnosis. Our Remote Second Opinion service allows you to have your medical files reviewed by a specialist doctor, giving you the peace of mind that comes with a second opinion. We'll help you identify the right specialist for your needs, facilitate the exchange of your medical files, and provide you with the final report. Get the assurance you need with PX6 Medical Systems, Inc.'s Remote Second Opinion service.

If you choose to purchase these services, the following applies: PX6 Medical Systems, Inc. will either

  1. purchase the Travel Service(s) on your behalf from the Service Provider or an intermediary ("Travel Service Provider"); this requires you to make an advance payment to PX6 Medical Systems, Inc., which will be used to pay the Travel Service Provider; or
  2. provide you with a link to purchase the Travel Service(s) directly from the Travel Service Provider at your own cost.

PX6 Medical Systems, Inc. will not be providing the Travel Services itself. Still, it will help the User to book them from the Travel Service Provider. Therefore, any agreements, questions, or complaints about the Travel Service(s) should be directed to the Travel Service Provider.

By booking with a Travel Service Provider (either directly or through PX6 Medical Systems, Inc. as your agent), you accept and agree to the relevant terms and conditions of the Travel Service Provider (including their cancellation and refund policies).

Suppose PX6 Medical Systems, Inc. purchases the Travel Service(s) on your behalf. In that case, the terms and conditions of the Travel Service Provider will be made available to you via the Terms & Conditions on the purchase page. If you wish to review, adjust or cancel the Travel Service once the booking is made, don't hesitate to contact PX6 Medical Systems, Inc. at their respective account representative within the PX6 user portal and follow the instructions.

4. Second Opinion

PX6 Medical Systems, Inc. offers Second Opinion services to the public upon request. This Service evaluates your current and past condition(s), medical history, diagnosis, and treatment plan by a medical specialist. It is not a substitute for primary care, and the Service provided through the portal may vary depending on your condition. We recommend that you have already obtained primary care from a local medical professional before using PX6 Medical Systems, Inc. Second Opinion. We encourage you to take advantage of this Service if you feel it is necessary.

The User understands and agrees that:

  1. the diagnosis they receive is only a preliminary one;
  2. the second opinion is not meant to replace a complete medical evaluation or an in-person visit with a doctor;
  3. the medical professionals providing services through this portal may not have all the information that is usually obtained through a physical examination; and
  4. the lack of a physical examination may affect the medical professional's ability to diagnose your condition, disease or injury accurately. We want to remind our public that these diagnoses are only preliminary and should not be taken as a substitute for a complete medical evaluation.

The PX6 Medical Systems, Inc., Second Opinion service gives the User access to additional medical information and evaluation from Doctors in the PX6 Medical Systems, Inc. network. This includes a range of primary medical specialties, such as general surgery, cardiology, oncology, neurology, orthopedics, dentistry, ophthalmology, and gynecology. Suppose the right specialist is not available in the Service Provider's network. In that case, PX6 Medical Systems, Inc. will contact third parties outside the network. Furthermore, the medical case cannot be judged remotely, even after obtaining all the necessary medical records. In that case, the User can choose to see the second opinion physician in person, subject to their availability. We hope this Service helps the public make informed health decisions.

The User agrees to allow PX6 Medical Systems, Inc. to collect, store, and transmit their medical records when requesting a service through the portal. This information will not be used in legal disputes, such as litigation, arbitration, disability benefits, worker's compensation, or malpractice claims. If the User wishes to provide medical records on behalf of a third party, they must notify PX6 Medical Systems, Inc. beforehand. This third party must be a family member of the User, the User must have their prior consent to represent them, and the third party must not be able to send a request via the user portal themselves.

The information provided to PX6 Medical Systems, Inc., including that from Service Providers and other third parties, should not be used as a substitute for medical consultation or examination. It should not be used to make decisions about starting or stopping medical treatment. Please provide PX6 Medical Systems, Inc. with your current and accurate identification and contact information to verify your identity and eligibility. It is your responsibility to ensure that this information is accurate and up-to-date. We trust that the information you provide is true and correct.

The User agrees that PX6 Medical Systems, Inc. qualified staff who hold permission may, at any time, look at their medical records from before and after their use of the portal, as well as any records created due to services received. PX6 Medical Systems, Inc. may also request additional medical records related to care received after the services. This is to help them better understand the treatment for the User's condition(s), including information about outcomes and costs, and to improve treatments and recommendations. We hope this helps the public better understand our process in a friendly and helpful way.

Upon receiving the necessary and accurate documentation, PX6 Medical Systems, Inc. will collect your medical records and create a Medical Case file. Based on the information provided, PX6 Medical Systems, Inc. will then match your Medical Case file with up to 3 different Doctors in their network of Service Providers, depending on the specialty of your diagnosis. You can choose which Doctor will provide you with a second opinion report. PX6 Medical Systems, Inc. will let you know via email when the entire Medical Case file is ready to be sent and will forward it to the Doctor you have chosen. Once the Doctor has reviewed the Medical Case File and completed the Second Opinion Report, PX6 Medical Systems, Inc. will send the report to you.

5. Payments, Deposits, and Down Payments

PX6 Medical Systems, Inc. offers a secure way to pay for your booking with a Service Provider or treating physician. We use a third-party payment Service Provider to process all payments through our platform. To ensure your booking is secure, we may require a Credit Card Deposit ("Deposit") or a Down Payment ("Down Payment") from you. We'll process the transaction and hold it in a non-interest-bearing trust account for the Service Provider.

When scheduling an appointment with one of our Service Providers, you may be asked to provide your credit card information for a Deposit. PX6 Medical Systems, Inc. will only authorize the third-party payment Service Provider commissioned for the handling of payments to collect the respective amount from the credit card account you identified in your purchase order if:

  1. a cancellation fee is applicable or
  2. a Deposit is required for the respective treatment. Specific treatments or Service Providers may require a Down Payment to be made by you. The respective amount and the cancellation policies will be displayed on the checkout page and in the confirmation email.

PX6 Medical Systems, Inc. will contact you and collect the necessary Down Payment amount. This amount will be held in a non-interest-bearing trust account until

  1. You decide to cancel the treatment or
  2. The Service Provider has requested the Down Payment from PX6 Medical Systems, Inc. and has informed us of the net amount of any prospective invoice issued to you.

The Down Payment will be refunded in full if any of the following conditions are met:

  1. a physician determines that the User is not eligible for the treatment (the User must provide PX6 Medical Systems, Inc. with a physician's certificate within two weeks of cancellation);
  2. a physician determines that the User is not eligible for travel (the User must provide PX6 Medical Systems, Inc. with a physician's certificate within two weeks of cancellation);
  3. in the event of a natural disaster such as an earthquake or war; or (d) in the case of death (automatic cancellation).

Suppose none of the above conditions apply, and the User fails to cancel the appointment. In that case, PX6 Medical Systems, Inc. will charge a cancellation fee from the Down Payment made by the User. The cancellation fee will be displayed on the checkout page and in the confirmation email.

6. Cancellation Policy

Suppose you decide to cancel your appointment with PX6 Medical Systems, Inc. In that case, the following cancellation clauses apply:

  1. You may cancel free of charge at least 20 days before your appointment.
  2. If you cancel 7 to 14 days before your appointment, a cancellation fee of US $50.00 will be charged.
  3. If you cancel within seven days of your appointment or do not show up, a cancellation fee of USD $100.00 will be charged.

The User may cancel the treatment free of charge if:

  1. A physician determines that the User is not suitable for the treatment (the User should provide PX6 Medical Systems, Inc. up to two (2) weeks after cancellation, a physician's certificate confirming the User's ineligibility for the treatment);
  2. A physician determines that the User is not eligible for travel (the User should provide PX6 Medical Systems, Inc. up to two (2) weeks after cancellation a physician's certificate confirming the User's ineligibility to travel);
  3. In the event of natural disasters such as earthquakes or wars; or
  4. In the case of death (automatic cancellation). For those wishing to reschedule, please give us three (3) days' notice before the appointment. Should you reschedule than three (3) days or not show up at the appointment, a cancellation fee of $100 USD will apply.

The User has the right to cancel Additional Services within 14 days of purchase, as long as the Services have yet to be provided by PX6 Medical Systems, Inc. or a partner's team. Suppose the User wishes to cancel or reschedule an appointment. In that case, they should contact their respective account executive within PX6 Medical Systems, Inc. The cancellation or rescheduling should include the User's full name, the Service Provider, the treatment, and the date and time of the treatment. It should be sent to their respective account representative within the PX6 user portal. Users have the right to withdraw from the contract according to the terms outlined below.

7. Rating Systems

PX6 Medical Systems, Inc. has set up certain types of channels on its user portal and website to allow users to share information about the services of Service Providers, exchange experiences and opinions with other users, rate Service Providers, and give recommendations to PX6 Medical Systems, Inc., other users, or Service Providers (these channels are referred to as "Rating Systems"). These Rating Systems are based on personal perceptions, experiences, and assessments of the users. We want to remind the public that they have no right to use or rely on the flawless functioning of the Rating Systems, and PX6 Medical Systems, Inc. reserves the right to shut down the Rating Systems at any time or interrupt the Service.

The User should only rate the services of Service Providers or other third persons they have personally used. It is not allowed to post ratings in the user feedback system provided by PX6 Medical Systems, Inc. if they contain false information, are offensive, or are not permitted by law (e.g. because they are abusive or disparaging). If the User violates this obligation, PX6 Medical Systems, Inc. reserves the right to delete the ratings and, taking into account the User's legitimate interests, to temporarily or permanently block the User's account. We kindly ask all our users to respect this rule.

The User consents to the permanent storage and sharing of their ratings posted in the PX6 Medical Systems, Inc. channels, even after their registration with PX6 Medical Systems, Inc. has ended.

8. User's Responsibilities

Individuals 18 years or older are eligible to use the services of PX6 Medical Systems, Inc. If a third person below 18 is to benefit from the services, the User must inform PX6. When using this user portal and website or the services provided by PX6 Medical Systems, Inc., the User must provide accurate and up-to-date information. If the User fails to do so, PX6 Medical Systems, Inc. reserves the right to delete the data and, taking into account the User's legitimate interests, to temporarily or permanently block the User's account.

Aside from what is explicitly stated in these Terms or any additional terms, PX6 Medical Systems, Inc. does not make any promises or assurances about the quality of the Services it provides, nor does it provide any guarantees. We shall only be liable for any damages caused to You

  1. by the intentional or grossly negligent actions of our directors, employees, or agents;
  2. resulting from the death or personal injury caused by a breach of obligations by our directors and employees. PX6 Medical Systems, Inc.'s liability shall be limited to the fees it has charged to you.
10. No Liability for third party Services

PX6 Medical Systems, Inc. cannot guarantee the accuracy, completeness, or timeliness of any information provided by Service Providers or other third parties on our user portal and website. We are not responsible for monitoring or verifying any external information transmitted or stored. Please use caution when relying on this information.

PX6 Medical Systems, Inc.'s user portal and website contain references (including weblinks) to the user portal and websites owned by third parties (e.g., Service Providers, travel agencies, or certification bodies), which PX6 Medical Systems, Inc. has no control over. The relevant owner or operator of the user portal and websites is solely responsible for the content of the linked sites. PX6 Medical Systems, Inc. does not accept any liability for this external content. When the links were first created, PX6 Medical Systems, Inc. did a quick check to see if there were any law violations; at that time, there was no apparent violation of the law. However, PX6 Medical Systems, Inc. does not constantly monitor the external content for changes that could lead to any liability for PX6 Medical Systems, Inc.

PX6 Medical Systems, Inc. is allowed to use the data, questions, and messages (e.g., to and from Service Providers) given by the User or contributions made by the User in channels, etc., for its business activities, as long as it follows the relevant data protection laws. We kindly remind you that your information is safe with us.

12. Validity and Modification of the Terms; relevant law; setting

PX6 Medical Systems, Inc.'s user portal, website, and Services by the User are subject to PX6 Medical Systems, Inc.'s Terms. The User's general terms and conditions or similar regulations are not accepted. These Terms will stay in effect until they are changed or ended by PX6 Medical Systems, Inc. If the User does not agree to these Terms, they must stop using the Services and close their user account immediately. We kindly remind you of the importance of adhering to PX6 Medical Systems, Inc.'s Terms. We thank you for your cooperation.

PX6 Medical Systems, Inc. may occasionally modify these Terms or any additional terms that apply to specific Services. Notifications of any changes to the Terms will be posted on this user portal and website, and notifications of modified other terms will be available in the applicable Service. These changes will not be applied retrospectively and will take effect within the completion of fourteen (14) days after they are posted. However, changes related to new functions for a Service or changes made for legal reasons will be effective immediately. Suppose the applicable law does not allow this choice; in that case, all disputes related to these Terms, any additional terms for specific Services, and the Services themselves shall be settled in accordance with the law. In the event that any part of these Terms is deemed invalid, unenforceable, or non-binding, the User will still be bound by the other provisions. In such a case, the invalid provision shall still be enforced to the greatest extent the law allows. The User will agree to accept a similar effect as the invalid, unenforceable, or non-binding provision, considering the contents and purpose of these terms and conditions.

This agreement is the complete understanding between You and PX6 Medical Systems, Inc. regarding using our user portal and website and Our services. Should any part of these Terms become invalid, the remainder of the agreement will remain in effect. We reserve the right to enforce any of our rights, and failing to do so does not constitute a waiver of such right.

You cannot transfer or assign your rights or obligations under this contract.
